TAi Grader Terms of Service

TAi Grader is a web-based educational technology platform that provides AI-assisted grading, feedback generation, gradebook management, answer sheet generation and scanning, and LMS integration tools for K–12 and higher education teachers.

The Service is available under a Free tier and a Pro subscription tier. Features available under each tier are described on the Pricing page.

You agree to use TAi Grader only for lawful educational purposes. You may not:

• Use the Service to process data of individuals who have not provided appropriate consent
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Share your account credentials with unauthorized users
• Upload content that is illegal, defamatory, or violates third-party rights
• Use the Service to facilitate academic dishonesty or fraud
• Circumvent usage limits or access controls
• Use the Service in any way that violates FERPA or applicable student privacy laws

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

By using TAi Grader with student data, you represent and warrant that:

• You have reviewed and comply with your school or district's policies regarding the use of third-party educational technology tools.
• You have obtained any required institutional approvals or data privacy agreements before processing student data through the Service.
• You are authorized by your institution to use AI-assisted grading tools with student submissions.
• You will not upload student data that your institution has prohibited from being shared with third-party services.

TAi Grader is not responsible for a teacher's failure to comply with their institution's policies. If your district requires a formal Data Processing Agreement (DPA), please contact us at [email protected] before using the Service with student data.

TAi Grader makes no warranty that AI-generated grades are accurate, fair, or free from bias. Teachers are expected to exercise professional judgment in reviewing all AI output before applying grades to student records.

We are not liable for any academic, disciplinary, or legal consequences arising from the use of AI-generated grades without appropriate teacher review.

Pro subscriptions are billed monthly or annually in advance via Stripe. All prices are in USD. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Monthly subscriptions renew on the same day each month.
• Annual subscriptions renew on the same date each year.
• You may cancel at any time from the billing portal. Access continues until the end of the paid period.
• We reserve the right to change pricing with 30 days' notice to active subscribers.

Failure to pay may result in downgrade to the Free tier and loss of Pro features. We will notify you before any involuntary downgrade.

After the 30-day window, refunds are not provided for partial subscription periods. Annual subscribers who cancel mid-year will retain Pro access until the end of the annual period but will not receive a prorated refund.

Refunds for duplicate charges or billing errors will be processed within 5–10 business days upon verification.

You own your data. You may export your gradebook, class rosters, and assignment data at any time using the export features within the application (CSV and PDF formats).

Upon account termination, you have 30 days to export your data before it is scheduled for deletion. We will send a reminder email 7 days before deletion. To request a complete data export, contact [email protected].

By you: You may close your account at any time by contacting [email protected]. Upon closure, your data will be retained for 30 days to allow export, then deleted.

By us: We may suspend or terminate your account for violation of these Terms, non-payment, or if required by law. We will provide reasonable notice except in cases of serious violations or legal requirements.

Sections 4 (AI Grading), 9 (Intellectual Property), 10 (Limitation of Liability), and 11 (Dispute Resolution) survive termination.

TAi Grader and its underlying software, design, and AI models are the intellectual property of TAi Grader. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended educational purpose.

You retain ownership of all content you upload, including student submissions, rubrics, and assignment descriptions. You grant us a limited license to process this content solely to provide the Service.

To the maximum extent permitted by law, TAi Grader shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or academic consequences arising from use of the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available." We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated content will be accurate or suitable for any particular purpose.

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the AAA Commercial Arbitration Rules.

You waive the right to participate in class action lawsuits against TAi Grader.

We may update these Terms from time to time. Material changes will be communicated via email and in-app notice at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
